What Lawyers Actually Cost in 2026: Hourly, Flat, Retainer, and Contingency Explained

Legal fees can range from zero (pro bono or contingency) to seven figures (major commercial litigation). Here is an honest map of what different types of legal work actually cost in 2026.

Estimate Your Legal Cost

Select your matter type and market tier for a ballpark range.

The Four Fee Models

Hourly

You pay per hour of attorney time. Rates vary enormously by market and practice area. Bills typically include time in 6-minute increments (0.1 hours). Associates bill at lower rates; partners at higher rates; paralegals at lower rates. Billed monthly with an invoice showing work descriptions.

Typical range: $150/hr (solo/rural) to $1,500+/hr (BigLaw partner)

Flat Fee

A fixed amount for a defined scope of work. Common for routine matters where the work is predictable: wills, simple divorces, LLC formations, trademark applications. Clarity on cost upfront. Scope matters -- changes outside scope may be billed separately.

Typical range: $300 (simple will) to $5,000 (trust package)

Retainer

An advance deposit held in the attorney's IOLTA trust account, billed against as work is done. The attorney bills monthly and the retainer balance decreases. Replenishment may be required (evergreen retainer). Unused amounts are returned on matter close.

Typical range: $1,500 - $10,000+ advance, depending on matter

Contingency

No fee if you lose; a percentage of recovery if you win. Standard in personal injury, some employment matters. Not available in criminal or family law in most states. Litigation costs (filing fees, experts, depositions) are still reimbursed from recovery.

Typical range: 33% pre-filing, 40% post-filing, 45% on appeal (personal injury standard)

Legal Aid and Pro Bono

Legal Services Corporation (LSC) is the federally funded organisation that funds civil legal aid organisations across the US. Income eligibility is typically set at 125-200% of the federal poverty level. LSC-funded organisations handle civil matters including housing, family, immigration, and benefits -- not criminal defence (public defenders handle that).

Law school clinics (operated by ABA-accredited law schools) provide free legal services in supervised settings -- students work under faculty attorney supervision. Clinics focus on civil matters in areas like immigration, housing, consumer, and family law. Most state bars track pro bono hours and encourage (but typically do not mandate) 50 hours per year per attorney. Many attorneys provide meaningful pro bono work in their speciality.

Frequently Asked Questions

What is a typical lawyer retainer?
A retainer is an advance deposit billed against as work is performed. Classic retainers range from $1,500 to $10,000+ depending on matter type. Unused funds are returned at matter close under ABA Model Rule 1.15. Non-refundable retainers must be clearly disclosed and are prohibited in some states.
Is a contingency lawyer really 'free'?
No upfront cost if you lose -- but if you win, the attorney takes 33-40% of recovery plus reimbursement of litigation costs. The total deducted from a settlement can be 40-50% of the recovery. Understand the full cost structure before signing a contingency agreement.
How do lawyers charge sales tax?
Legal services are exempt from sales tax in most US states. Hawaii, New Mexico, South Dakota, and Washington apply gross receipts or sales tax to some services including legal. Most clients will not see sales tax on legal invoices.
Can I negotiate an attorney's hourly rate?
Yes, for long engagements, high volume, or repeat business. Many attorneys will cap monthly fees, offer blended rates, or discount for prompt payment. Contingency percentages are harder to negotiate as they reflect market standards.
Is LegalZoom a real law firm?
No. LegalZoom is a document preparation service, not a law firm. It does not provide legal advice and does not create an attorney-client relationship. For representation in court or a complex transaction, private counsel is needed.
What happens to unused retainer money?
Under ABA Model Rule 1.15, unused retainer funds held in trust must be returned to the client when the engagement ends. An attorney cannot keep unused retainer funds. Trust account misappropriation is one of the most common causes of disbarment.
